KARACHI, Dec 28: The Sindh High Court issued notices to the advocate-general and respondents in a petition challenging appointment of advisers to the chief minister. The petition, moved by Advocate Munir Ahmed Chandio of Thatta through Advocate Abdul Waheed Katpar, says there is no provision for appointment of advisers to the CM in the Constitution, which only allows the prime minister to have five advisers vide its Article 93. Naming the seven recently-appointed advisers as respondents, it seeks a complete list of advisers.
It recalls that while inducting seven new advisers on Oct 31, the CM had declared that the appointment of advisers in Sindh was in accordance with the law and rules.
Besides the advisers, the petition cites the provincial government, the CM and the provincial governor as respondents. It came up before a bench comprising Justices Mushir Alam and Amir Hani Muslim.
CITIZENSHIP CLAIM: The bench also issued notices to the provincial and federal attorneys in a petition by a four-member family for grant of Pakistani citizenship. One of the petitioners, Mst Sana, said she has married a Pakistani relative, Mohammad Iqbal Bawany, and was entitled to Pakistani citizenship under the amended Citizenship Act of 1951.
Her father, Mohammad Afzal, said his parents belonged to Pakistan and he was sent to India to look after family property in India. The petitioners claimed that they left India 14 years ago and shifted to the United Arab Emirates.
They came to Pakistan in 2000 after disposing of all their assets abroad and invested over Rs5 million in a Pakistani concern. Instead of considering their case for nationality, they have been interned by the special branch police in Karachi for deportation to India as illegal immigrants.
They said they had no place to go to in India after selling their immovable property.
DEMOLITION: By another order, the court asked its nazir to supervise the demolition of an illegal structure on plot LEE-3/26, Lee Market, Lyari Town. The court had earlier order attachment of the complex.
A non-governmental organisation submitted through Advocate Abdul Jabbar Korai that the owner of the plot has constructed an eight-storey complex though the Karachi Building Control Authority had sanctioned a plan for three floors.
