RAWALPINDI, Nov 30: The administration of Islamabad on Tuesday told the Lahore High Court (LHC) that out of five men acquitted in two suicide attacks, detention orders for three were issued on police's request as they are considered risk for public peace.
Awaiting the response of the additional magistrate of Islamabad in identical petitions of two other acquitted but detained men, Justice Sagheer Ahmed Qadri put off the hearing till December 3.
“The authorities have said that the men had been acquitted in cases of suicide attacks on Islamabad police's special branch office and the check post of Frontier Constabulary in March last year but they could not be released as police still considered them dangerous for public peace,” said Advocate Wajeejullah, representing one of the petitioners.
Fidaullah, Khurram Shahzad, Khairullah, Obaidullah and Mohammad Awais have challenged their detention orders by the additional magistrate on October 30 — the day Anti-Terrorism Court acquitted them in two cases.
In written comments, the authorities said the five men could not be released as Fidaullah was being tried in another terrorism case and other four were feared to be involved in more cases.
Making secretary interior, Adiala Jail superintendent, and senior superintendent of police, Islamabad, respondents, the five men's petitions have challenged their detention, saying they could not be kept in jail without any charges.
The petitions maintain the detention orders could not be considered 'lawful' as the five men were acquitted after facing 18-month long trial.
