IHC moved against PM

ISLAMABAD, May 10: A petition seeking removal of Prime Minister Yousuf Raza Gilani was filed with the Islamabad High Court (IHC) on Thursday.

A single-member bench will take up the petition on Friday.

On May 2, the IHC had declared the petition as premature and advised the petitioner, Advocate G.M. Chaudhry, to wait till the issuance of the detailed judgment of the Supreme Court in the contempt case against Mr Gilani.

The petition is almost the same but the mover has added that after issuance of the detailed judgment the IHC may hear his plea.

The petition said the IHC should not wait for appeal of the convicted prime minister as due to shortage of judges it was not possible for the Supreme Court to constitute a larger bench for hearing of the appeal.

“Moreover, the induction of new judges would be subject to the approval of the parliamentary committee and the summary of judges would be routed to the President through the convicted prime minister,” he said and added that the prime minister would delay the matter and may also linger on the judges’ appointment till next general elections.

The petition pointed out that in accordance with the provisions of paragraph (g) of clause (1) of article 63 of the constitution, Mr Gilani had been disqualified from being a member of the National Assembly after his conviction.

The petition requested the court to stop Mr Gilani from acting as the prime minister.— A Reporter
