ISLAMABAD, June 2: Another petition has been filed in the Supreme Court against the May 24 ruling of National Assembly Speaker Dr Fehmida Mirza which had saved Prime Minister Yousuf Raza Gilani from being disqualified after his conviction in a contempt case.

Petitioner Chaudhry Khalid Farooq, who filed the petition on Saturday through his counsel Abdur Rehman Siddiqui, requested the court to quash or set aside the speaker’s ruling for being illegal and without lawful authority and against provisions of the Constitution.

PTI chief Imran Khan, PML-N leaders Khawaja Muhammad Asif and Senator Zafar Ali Shah, Advocate Mohammad Azhar Siddiqui and Syed Mehmood Akhtar Naqvi, a citizen, have already moved similar petitions against the speaker’s ruling.

A three-judge bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Jawwad S. Khawaja and Justice Khilji Arif Hussain will take up the petitions on June 6.

The latest petition says the court should disqualify Ms Mirza from being a member of the National Assembly and the speaker and take stern action against her for allegedly subverting the Constitution, breaching the trust of people and committing contempt of court.

Prime Minister Gilani, it said, should also be declared disqualified from the National Assembly. The office of the prime minister and his cabinet stood dissolved on April 26 (the day the Supreme Court held the prime minister guilty of contempt), the petitioner said.

He requested the court to declare void, ultra vires, coram non judice, illegal and without lawful authority all decisions taken by the prime minister and members of his cabinet.
