ISLAMABAD, June 19: Justice Shaukat Aziz Siddiqui of Islamabad High Court (IHC) on Tuesday issued show cause notices to two senior officials of the Capital Development Authority (CDA) for showing their loyalty to Faisal Sakhi Butt, the chief coordinator of the prime minister for Islamabad.

The court on May 14 while hearing a land allotment case had barred Mr Butt, the then chairman prime minister task force on CDA, from entering its premises and also directed the officials of the civic body not to visit his residence in their official capacity.

Justice Siddiqui, while again hearing the land allotment case on Tuesday, pointed out that media reports suggested that the CDA director general (planning) Ghulam Sarwar Sindhu and director municipal administration Mansoor Ali Khan not only met the businessman but also assured him of their full cooperation and support.

The learned judge observed that since the CDA officials did not deny or rebut the news, he was fully convinced that they were defying the court orders.

The court said, “the news item shows that the CDA officials in order to show loyalty to Mr Butt met him which is nothing except political style of ridiculing the court orders and showing disrespect to the judiciary.

“The act of the CDA officials clearly comes under the ambit of contempt of court and its initiation is essential because the court would not allow any one to ridicule its orders,” the order said.

The court summoned the officials on June 26 and adjourned the hearing.

While hearing another petition filed against the notification of Mr Butt as chairman of prime minister task force on the CDA, the same court observed that since the portfolio of the businessman had been changed and the task force did not exist anymore, therefore, the matter could not be heard.

The court, however, on the request of the petitioner barrister Zafarullah Khan allowed to change the nomenclature of the portfolio of the respondent.

Barrister Khan told the court that re-designation of Mr Butt from chairman task force to chief coordinator was also illegal and unconstitutional.

He said there was no provision in the constitution to appoint chief coordinator for the capital city.

He requested the court to amend the petition accordingly.

The court directed the CDA chief legal advisor barrister Masroor Shah to provide a copy of the new notification of Mr. Butt regarding his appointment as chief coordinator and also adjourned the matter till June 26.

Meanwhile, the IHC Chief Justice Iqbal Hameedur Rehman while adjourning a contempt of court plea against the director general intelligence bureau (IB) directed him to implement the court order regarding the promotion of reinstated IB officials under the Sacked Employees (reinstatement) Act 2010.

The court on March 30 directed the DG IB to promote the 40 inspectors, who had been reinstated under the said act, to the post of assistant director.

Islamabad High Court (IHC) served show cause notices on the following since January this year:

I. Federal Minister for Housing and Works Faisal Saleh Hayat in a contempt of court case as he failed to implement the court orders in a petition seeking restoration of suspended government officials.

II. Secretary Housing and Works Kamran Lashari in the same contempt of court case.

III. Capital Development Authority Chairman Farkhand Iqbal in different service matters and land compensation cases.

IV. Acting president Zarai Taraqiati Bank Limited Rohi Raees Khan, for violating court restraining orders against new recruitment.

V. Secretary Capital Administration and Development Division Imtiaz Inayat Elahi in teachers promotion case.

VI. Secretary finance Waqar Masood, in assistant upgradation case.

VII. Secretary industries Aziz Ahmed Bilour in assistant upgradation case

VIII. IG Islamabad in the case of recruitment in the Islamabad Police.
