ISLAMABAD, Nov 19: Justice Riaz Ahmed Khan of Islamabad High Court (IHC) on Monday dismissed the petition of Bahria Town (BT), against the orders of Shoaib Suddle commission.

The commission had demanded income tax details in connection with its ongoing probe in the Arsalan Iftikhar corruption case.

BT had challenged these directives before the IHC bench through its counsel Syed Tauqeer Bokhari advocate, describing it as illegal.

The petitioner had adopted before the court that under section 176 of the Income Tax ordinance 2001, only commissioner of Inland Revenue and no one else could issue notices seeking the said information.

The counsel said that seeking the information is illegal and in violation of article 04, 09, 10A, 14, 18, 19A and 24.

The counsel also told the court that the directives caused mental agony to his client as under the laws no one could direct a person to produce income tax details except the relevant authorities.

The same directives were also in contravention of section 216 of the income tax ordinance 2001. The petitioner requested the court to declare the directives as unlawful.

The IHC bench while hearing the case directed the petitioner to put the same matter before the commission headed by Mr Suddle.

The court observed that the commission is working under the directions of the Supreme Court of Pakistan and in case the petitioner feels aggrieved over any order, then he should follow standard procedure.
