LAHORE, Feb 20: A civil judge Islamabad has ordered POA interim committee chairman Asif Bajwa to pay an amount of Rs50,000 to POA president Arif Hasan in four weeks, while also rejecting his (Bajwa) claim that the latter is not the genuine president of the POA.

In his judgment, the learned judge, Adnan Jamali, states, “As seen above, the whole cause of action of Plaintiff (Asif Bajwa) is based on the judgement of Honourable Supreme Court, ibid, herein the tenure restrictive clauses i.e. section 10 and 11 of National Sports policy-2005 were revived. I have gone through the judgement and in utter dismay I am penning it down that Plaintiff has deliberately misguided this court by hiding the operative part of court’s judgement, which has deadly effect on Plaintiff’s cause. In the said judgement His Lordships of Honourable Supreme Court have specifically distant Pakistan Olympic Association from the application of National Sports Policy-2005 on his functioning. Their Lordship observed as under:

“Respondent No.5 namely, Pakistan Olympic Association was not affected by the impugned judgement and remains unaffected by our present decision.”

“On 12-2-2013 Defendant No.1 (Arif Hasan) appeared in court and placed on record copy of order sheet dated 7-2-2013 of Honourable Islamabad High Court, wherein a status-quo order was passed by his Lordship Justice Noor-ul-Haq N. Qureshi and in defiance of such order present Plaintiff without fear of any consequence filed instant suit on next date i.e. 8-2-2013, which shows that Plaintiff has no respect for superior court. In my view it is nothing but sheer abuse of judicial process. Therefore, the plaint is rejected U/o VII-II CPC being devoid of merit and cause of action with costs of Rs50,000 which shall be paid to defendant No. 1 (Arif Hasan) within four weeks from today.”
