Four-member FIA committee to probe Musharraf treason case

ISLAMABAD: Pakistan's federal government has moved one step closer to putting former military dictator General (Retd) Pervez Musharraf on trial for treason, by appointing a committee to investigate him for subverting the constitution.

Federal Interior Minister Chaudhry Nisar Ali Khan informed the National Assembly on Thursday that a four-member committee of the Federal Investigation Agency (FIA) had been constituted to probe treason charges against the former military chief.

Nisar said the investigating team comprises of two directors and two additional director-generals of the FIA, and that the team would complete its investigations over treason charges against Musharraf and submit a report to the government soon.

He added that the committee would hold meetings with him on a weekly basis.

Ppposition member and Pakistan Peoples Party (PPP) senior leader Makhdoom Amin Faheem said Article 6 of the Constitution should be applicable on everyone from October 1999 onwards. He said that applying the law only to the former dictator's November 2007 actions was tantamount to double standards.

Faheem said his party had supported Prime Minister Nawaz Sharif's announcement to try former President Musharraf in the high treason case, adding that it was for the first time in the country's history that the government has moved the court on Article 6.

He further said that justice should be served and accountability should be carried out across the board.

Speaking to a private television channel earlier on Wednesday, Faheem had said that the apex court should have also taken up the 1977 coup by former military dictator Zia ul Haq.

Another opposition member of the National Assembly, Awami Muslim League chief Sheikh Rasheed Ahmed, said that Article 6 should be applicable to all who committed treason 1956 onwards.

Speculation has been rife during the past two days over the seriousness of the Pakistan Muslim League - Nawaz (PML-N) government in pursuing the treason cases against Musharraf.

Meanwhile, the Supreme Court adjourned the hearing of the treason case against the former military dictator for an indefinite period to hold consultations over setting up of a special court to hear the case against the ex-army strongman.

The apex court also rejected a plea to order the formal arrest of Musharraf citing that no formal charges against the former president had been put before the court.

Earlier during the hearing , Attorney General Munir A. Malik submitted the government’s line of action in the case which said that Prime Minister Nawaz Sharif had ordered the FIA to conduct an inquiry into the actions of Musharraf on November 3, 2007, the day when he held the constitution in abeyance and imposed emergency in the country, sacking dozens of judges of the superior courts.

AFP adds: Musharraf's lawyer Ibrahim Satti urged the Supreme Court to give his client a fair trial, accusing the media and Sharif of being biased against him.

“In this background the answering respondent is expecting and having full hope that this bench will safeguard and protect the interest and civil right of him regarding fair trial,” said Satti, speaking in English.

Presiding judge Jawwad S.Khawaja said he would deliberate further on the issue and set no date for another hearing.

Later, the bench adjourned the hearing until further notice, in order to hold consultations with Chief Justice Iftikhar Muhammad Chaudhry over the constitution of a special court to hear the treason case.

supreme court's mandate is to provide justice and not tip toe sharif's line. The court should arrest the culprit in Asghar khan case, try arslaan ifthikar for committing serious misuse of authority, put Malik riaz and malik anjum and chourdry mooins elahi in prison for stealing govt. land and then try musharraf, only then the court would be respected . Just trying an ambitious general for act ( that really doesnt amount to anything to most pakistanis) is not a good enough excercise particularly when the previous govt has looted Pakistan like never before and gotten scott free under the watchful eyes of the court.

At the end of the day nothing will come out of this, Only the common masses attentions will be diverted for the core and chronic issues and sensationalist media will cook-up this case. Reconciliation is cry of the hour for this country. Personal vendetta will lead this country to no where.

Pakistan is facing serious challenges: law and order situation, terrorism, loadshedding and high food prices etc so trial of Gen Musharraf is not a priority. Let him live in his sweet home (now sub jail) and enjoy his life. We should not create a panicky situation. Let Govt and Supreme Court of Pakistan pay some attention to the NRO implementation case and haul up all cheaters and plunderers of Pakistan wealth including Zardari the mischievous man and all abettors etc. We must bring back the USD62 million.

It is a pity that those parliamentarians who, in the past, legitimized the dictators' actions thru constitutional amendments are now confusing people by calling for taking actions since the day Pakistan was created or else let everyone off the hook. The same logic is applied in case of accountability and corruption cases. Either catch all the target killers and punish them or set free those also who have been caught red-handed. Amin Faheem, Fazlur Rahman and Sh Rashid were the ones who gave legal protection to the actions of Oct 99 and they were the ones who helped Musharraf's re-election as president in one way or the other.

If a PM is sacked and exiled no treason action but validation If a PM is sacked and hanged up no action but validation Dictators along validators and supporters should be equally treated. What I would really like to see (and I am sure there would be others too) is the agreement he signed before he left for Saudi Arabia. Can he show us a copy of the agreement?. I would also like to know what did he carry with him in that plane that took him to Saudi Arabia?. How much cash?. How much foreign currency?. Also, what Mr. Sharif has to say about him attacking the supreme court?.

The problem is that the Supreme Court, headed by the same CJ, has previously validated Musharraf's illegal actions of 1999. Trying him for the 1999 actions once again will be double jeopardy. Zia's 1977 takeover has also been previously blessed by then supreme court under the doubious legal principal of the doctrine of necessity. As much as I would like to turn back the clock and see Zia hanged instead of Bhutto, I think it best to focus on the 2007 actions ans set a legal precidence which will make any future wannabe dictator think twice about overthrowing an elected government.

If we are not able to move beyond our past then there will be no future. Our inherent inability not to learn from our past mistakes despite the present challenges of insecurity, inflation, poverty, energy deficiency. How is trying the former president a solution to the present crisis, will it alleviate the suffering of the common man? and how about trying those who openly pillaged in the last five years. The later will again get away from accountability since the the judiciary and the 'selected' representatives, have banded together as a fraternity with no real solutions to the present crisis but mere distractions.

Truly patriotic Pakistanis must be cringing that they have lost ONE OF THOSE RAREST of rare Pakistanis whose ONLY intent was to make Pakistan strong & invincible.......using all means. No doubt like all dictators he relished power, but again he was one of the very few dictators in in the world who gave up power, while being at its height, with the false notion of getting back into power using democratic means. On the contrary, patriotic Indians & Indian Americans (me included!) will be mighty pleased that given this guy was: a) The architect of the Kargil war b) Protector-in-chief (covert) of Osama Bin Laden c) Fine tuned the dubious Pakistani policy of aiding the Taliban, while demanding huge sums of money & military eqpt. purportedly to fight them, thus being directly responsible for 1000's of American & NATO soldiers killed in Afghanistan. Having said that, everyone knows that Pakistani politicians (way more than Indian politicians, who also are among the worst in the world!) are among the most corrupt and there's less likelihood that Pakistan will be allowed to develop like other nations under these corrupt souls. Finally, the real credit for all this drama (real life) of holding Gen. Musharaff accountable is going on ONLY b'coz Gen. Kayani is a apolitical guy, who while being as interested in keep Pakistan strong as Gen. Musharaff was, is not the least interested in entering politics.

Sh Rasheed's contention is just & logical. Any General, Judge or a Politician who abbetted, validated or served a dictator since 1958, should be tried. Sharifs are no angels, they must have already thrown a BAIT to FIA officials, Judges for promotions,extentions in tenures or elevations to superior positions(PPP did release justice Qayyum/Sharifs Tele conversation during election circus). Pakistanis are Phds in Corruption.

The general is not a coward to go pale! He knew this could happen to him and still decided to come back to his country! Listen to his earlier interviews. He was repeatedly asked by many forums why he wants to go back to Pak where he could be tried...his reply was always the same..I know that is a possibility, however I am a Fauji and I feel I have to give it a try to attempt to save my country from the corrupt! Whatever anyone may call the general,..He was not a corrupt man! Yes he made mistakes like every human being,,however the good he did for the country in his rule was much stronger than the damage that his mistakes may have caused. Mian sharif is once again showing his true colours!

I believe, Nawaz along-with cheap justice Chaudhary (who nominated President Musharaf with his own signature), should be liable for any mishaps to Musharaf, just like they blame him for Bugti since he was a president. We all know, that Musharraf was in the plane when Nawaz (PM) wanted him to land in India, and the generals on land brought the military coup. I hope the truth comes out for all involved.

@Nadir: well said Nadir and moreover if you seriously ask me this subverting the constitution is not like subverting the Holy Quran, but on the other hand looting and plundering with both hands should be punishable with the severest form of punishment. Nawaza and Zardari and their cohorts are to be tied in the main square. Some army guys who have stolen too should be brought to task. As far as Musharraf is concerned the least one can say is that he is a Pakistani before anything else. The ideal person should be very high in Taqwa.

This picture is 2-3 months old and was taken during an early morning court appearance after he had spent a night in a police officers mess. They have realized that they are unable to fulfill their bloated promises made during the election campaign and have now resorted to petty attempts of diverting public attention by settlings personal scores. In a time when the government resources should be carefully allocated to address critical issues of public interest, they're setting up mock trials that will lead nowhere. The basic human needs like electricity, clean water, medicines, fuel etc. are in jeopardy. Terrorists are challenging the writ of the government on a daily basis, our historical landmarks are being destroyed, foreign tourists are being murdered in cold blood, image of the nation is being tarnished across the world and these buffoons are trying to destabilize the already fragile institutions of the state. If you start from 1956, you will find that others have committed bigger crimes. Nawaz and SC are on a vendetta trip. Nawaz himself has committed bigger crimes. He is the one who physically attacked the SC building, and the judges had to hide in their chambers. Their is no other instance of this type of attack in the history of the world. The government will do this in order to divert public's attention from the real issues of energy, terrorism, economy, jobs, health, etc. Most of the educated people of Pakistan (home and abroad) are on the side of Musharraf. If Nawaz government does not catch wisdom, I am afraid, there will be grave consequences, including marshal law in the country.

MUDDAI BHI TU MUNSIF BHI TU. Who will provide justice to Parvez Musharraf when Nawaz Shareef and Iftikhar Chaudhry are both enemies of Parvez Musharraf? But God is there and surely HE will do justice with this innocent person.

All dictators aliveor dead must be charged. There court should decide wheather they were criminals or not. Their ranks should be taken back and pension should be denied and all the medals bestowed on them be cancelled.

@Nadir: Agree with everything you have said. I still remember the pictures on our TV sets where people were dancing on the streets of Lahore and most big cities and towns of Pakistan as soon as they heard that Nawaz was gone. The situation now is clear to most people in Pakistan. Nawaz Sharif, who attacked the supreme court (we have all seen the pictures) and damaged government property now claims to be the saviour of judiciary in Pakistan. PMLN will agree to everything Supreme Court does as long as they benefit from the decisions. Mr. Sharif, this was your chance to prove to the nation that you are above all these petty things but you have done what you have always done. No surprises there.

What a thank less nation! A man who gave them economic success, brought women into parliament, allowed the media to prevail has been put behind the bars by the same people. We the lower middle class/ the real tax payers, do not give a damn about the 1973 constitution, we dont even know what does article 6, 62 or 63 stands for! what we are concerned about is the govt providing us with the basic necessities of life, only during musharaf's 8 year tenure we were given all that, we even were respected around the world because of him. He defended Pakistan in every forum unlike our present GLIB politicians and journalists. You really are a brave man Mr musharaf! I salute you, these thankless journalists, and the people dont deserve an honest man like you , they are better off living under the ignominious rule of the chaudhry's(pml,n).

President Musharraf is our hero, he saved Pakistan from American threat of 9/11 attack on twin tower, USA threatened Pakistan to destroy to that extent to stone age. think over a frustrated country wanted to attack any where in the world to get revenge. In this situation pervez musharraf thought this is the best solution to protect from American hand, you have example for Afghanistan what America did to them. Atleast musharraf protected pak. Now unfortunately thing has changed in Pakistan, musharraf did not know the repercussions of supporting America. I give you example of president Charles D'gaule of France when, when hetler decided to attack France in 2nd. World War D'gaule then was commander he decided to save paris because it wanted to intact the beauty of the city therefore he welcomed the German army In the city, this way he protected city. If you thik over what musharraf did wrong, in my opinion he did the best as the head of the states Pakistan cj is taking revenge so is nawaz sharif, we all overseas pakistani are with musharraf. He is completely innocent of all charges.

@Sayeed Altaf Hussein: In the history of Pakistan there are few leaders who have never been involved in the corruption and looting the public wealth. Musharraf is one of them beside Zulfiqar Ali Bhutto. He came to rescue the country from the evils and to take it on to the path of the progressive again. He is the only Pakistani leader known in the Western world for his bright vision, knowledge and fighting alone for the country's respect and dignity. The rancour and personal animosity will not give any thing good to the country. Har shaakh per ullu betha hai anjame gulistan kaya hoga.

@Khaid: No the Prime Minister can not do anything he wants. He got to do what the Constitution of the Pakistan allows and the parliament allows. On the other hand you can make baseless comments without any proof. Your naive suggestion that he had all his wealth in one bag sitting at home which the Dictator allowed him to take, is as silly as the rest of your post. What right have you or I have to raise such questions? He was thrown out of office by an Army chief without any legal authority, he may have agreed anything to save himself and his family. Any individual would do that under duress. No court of law in the world will credit any information acquired under duress. If you think he did something wrong then it is your problem.Normal people find useful occupation to pass their time . Not right for a decent citizen. Besides what this red hering got to do with the subject in hand ?

I am getting the feeling that his government will be dismissed before the expiry of its term; unless he gets out of vendetta business and starts working on the problems of the country. I am not very hopeful.
