IHC rejects petition to add Musharraf's name to ECL

ISLAMABAD: The Islamabad High Court rejected a petition submitted by Haroon Rasheed Ghazi, a son of the slain Lal Masjid cleric Maulana Abdul Rashid Ghazi, which sought to add Musharraf’s name to the Exit Control List, DawnNews reported.

The court said that the former president was already under custody of police adding that it was the Interior Ministry's responsibility to add names to the ECL.

Earlier, the bench led by acting Chief Justice of the IHC Justice Riaz Ahmed Khan while adjourning the hearing had reserved its judgment.

In his petition Ghazi had claimed that the Aabpara police station in Islamabad was investigating Musharraf for ordering the Lal Masjid operation in 2007, and therefore he should be barred from leaving the country as the former dictator may not return again if he was allowed to leave .

Meanwhile, an Islamabad sessions court hearing the Lal Masjid cleric's murder case sent the former military strongman on a 14-day judicial remand.

The court had earlier rejected the request of Islamabad police seeking physical remand of former president Gen (r) Pervez Musharraf.

Police had submitted a request seeking five-day-remand of the former dictator over the case pertaining to the alleged murder of cleric Ghazi Abdul Rasheed and his wife during the Lal Masjid military operation.

The bench hearing the case rejected the police request saying that the remand could not be granted without producing the accused in court.

Police had registered a case against Musharraf last month after receiving an order from the Islamabad High Court over the murder of the Abdul Rashid Ghazi during the 2007 Lal Masjid operation.

Earlier on Thursday Pakistan’s former military ruler General (retd) Pervez Musharraf was arrested in Lal Masjid (Red Mosque) killing case just hours after submitting surety bonds in the Supreme Court.

The bonds were submitted in connection to the three other major cases pending against the former president, namely the Benazir Bhutto murder case, judges' detention case and the Nawab Akbar Bugti murder case.

Musharraf was granted bail the other cases and his lawyer had said on Wednesday he was cleared to leave the country.

Placing him on bail with no restrictions is equivalent to asking him to leave the country. The solution of Musharraf has always been sitting in front of you - after you arrest him put him on trial - that's the way the system is suppose to work - use it.

Only in Pakistan you are arrested for dealing with those who challenge state's writ (no difference between Bugti and Lal Masjid miscreants in this regard) while people like Sufi Mohammed are let off the hook for challenging state's writ,

Musharraf's 14 day judicial remand in the murder case of Ghazi Abdur Rashid can only be seen as mockery of justice. Ghazi's name will ever be remembered as a person who harbored heavily armed militants inside the mosque and used innocent children as human shields, an extremely shameful act which demands a post death judgement against him, a judgement to fix primary responsibility of the murder of innocent children and create a state within a state. Will blind justice give any heed to that fact? Musharraf's govt. was made fun throughout the world for inaction against the militants for days. Innocent lives must have been saved but facts of the tragedy can't simply be ignored by making Musharraf a scapegoat.

Maulvi and cleric like Maulana Abdul Rashid Ghazi are the major source of all the extremisim and terrorism we see in the name of Islam. Atleast Musharraf had guts to go against such people, it is a pity that his brother was released instead of being jailed for life.

The Congress is directly to be blamed for not passing the budget for 3 months under continuing resolution. Secondly, Republicans should have come to some understanding & compromised over the Affordable Care Act. Republicans are very much aware the President of USA has the Veto power & can always use it as a trump card.

@IAJ: He is a dictator who is responsible for kidnapping and selling the people in the name of war on terror. He has blood of lots of innocent people on his hands and should be tried and punished as per the law of Pakistan. His bail bonds should not have been accepted since "He Ran Away from the Court" and once he exists the country he would never return!

@Masood Hussain: You obviously have forgotten - overlooked perhaps,that one of the IHC judges was attached previously with the Lal Masjid weirdos,as their lawyer.He's still sitting with/for them,perhaps craftily trying to influence fellow judges,but has had to ostensibly withdraw from the Musharraf-trial IHC Bench - possibly under peer pressure,as one politely puts it! Perhaps it is all part of 'legalistic fun and games'.
