PHC directs govt to make legislation on fate of prisoners

PESHAWAR: The Peshawar High Court on Tuesday directed the government to make necessary legislations before withdrawal of security forces from Malakand and Fata for quick and speedy disposal of the cases of the prisoners, who are kept in internment centres.

A two-member bench of Peshawar High Court comprising Chief Justice Dost Muhammad Khan and Justice Nisar Hussain passed these orders while hearing a case of missing persons filed by petitioner Idress and others.

The bench directed the Federal and Provincial Governments to make necessary legislation and amendments in anti-terrorism laws so that accused involved in terrorism and subversive incidents could be brought to justice.

The court ruled that legislations and amendments should be made with extra care and consultations with all the stakeholders to avoid constitutional and legal complications in future.

In case of withdrawal of security forces from Malakand and Fata, the bench observed as to what course of action would be adopted for prisoners, who were kept in internment centres.

The Court ruled the accused charged in terrorism-related cases can take advantages from the shortcomings in the existing anti-terrorism laws if necessary amendments were not made.
