ISLAMABAD, Sept 19: The Lahore High Court, Rawalpindi bench, on Friday allowed Privatization Commission (PC) to hold second round of bidding for the sale of the 90pc shares of Thatta Cement Company Limited (TCCL).

Haji Saifullah and M/s Al Abbas and others would be free to participate in the auction, which should be held by PC not before seven days from September 19, 2003.

The court disposed of the suit filed by Haji Saifullah against Privatization Commission to prevent it from accepting the bid for sale of 90pc shares of Thatta Cement Company Limited (TCCL).

The counsel for the plaintiff said that his client was content with the court decision as he had wanted that second highest bid by M/s Al Abbass should not be accepted.

The suit of Haji Saifullah against the PC was fixed before Justice Ali Nawaz Chohan of Lahore High Court, Rawalpindi bench, for hearing of the injunction application on Friday.

Syed Iqbal Haider Advocate, former attorney general, appeared on behalf of the PC.

After hearing arguments by Advocate Hassan Aurangzeb, counsel for the plaintiff and Iqbal Haider Advocate of the Privatization Commission, the Court disposed of the suit and application for interim injunction.

The court, however, directed that transparency in such transaction should always be ensured and if the Plaintiff had any grievance he may make a representation to Privatization Commission within one day.

The Privatization Commission should communicate its decision on such a representation if filed by Haji Saifullah within five days, after hearing him.
