LAHORE: A full bench of the Lahore High Court (LHC) on Monday banned the live telecast of Muttahida Qaumi Movement (MQM) Chief Altaf Hussain's speeches on TV channels till further orders.
The court, while banning the live broadcast of speeches made by the MQM supremo, also issued notices to the foreign secretary, interior secretary and secretary to the prime minister, seeking details of Altaf Hussain's nationality.
A three-member bench headed by Justice Mazahir Ali Naqvi and comprising Justice Mazhar Iqbal Sidhu and Justice Erum Sajjad Gul, heard a petition seeking proceedings against MQM chief Altaf Hussain and other leaders of the party for alleged treason.

The petition, filed by advocates Abdullah Malik, Aftab, Maqsood and others, called for a lifetime ban on live telecast of Altaf Hussain's speeches.
The petition maintained that Altaf was in violation of Article 5 which asks for showing loyalty to the state and obedience to the constitution. Hence a case of treason should be registered against the MQM chief under Article 6 of the Pakistan Penal Code (PPC).
Additionally, the court sought record of Hussain's speeches in the past from the additional advocate general (AAG) and the advocate general of Punjab.
The hearing was subsequently adjourned till September 7.
Workers and supporters of the Muttahida Qaumi Movement on August 21 had gathered in front of the Karachi Press Club to protest against the Pakistan Electronic Media Regulatory Authority (Pemra) for allegedly imposing an unannounced ban on airing Altaf Hussain’s speeches on television channels.
Speaking on the occasion, senior MQM leader Dr Farooq Sattar had said that the Pemra ban on Mr Hussain’s speeches was unjust. The freedom of expression was being blocked in Karachi as authorities were not willing to tolerate voices of dissent, he had added.

In July, FIRs were registered in different parts of the country against Altaf Hussain for remarks made by him against the chief of Rangers in Sindh and the paramilitary force in recent speeches.
In the FIRs, Hussain was accused of involvement in cases of criminal conspiracy, waging or attempting or abetting the waging of war against Pakistan and committing acts of terrorism.

There is a huge difference between free speech and irresponsible speech. The more popular the leader you claim to be, the more the responsibility on your shoulder to choose your words well before delivery. You cannot be uttering abuses every evening and apologising the next morning. This is not what leaders of political parties do. The Lahore High Court has made a reasonable decision. Let this be a lesson to all leaders who have easy access to media.

This will make MQM more stronger in same way it made Pakistan Army more stronger when sanctions were imposed. We should spread pluralism, acceptance of others opinion and one always have the option of not listening.
If any one try to handle politics by force, other always get benefit in long run and example is PPP where they were always forced to leave Govt. and they revert with more votes, this time wen they completed their term but at the end people did not voted for them.

Freedom of expression does not mean that anyone has the right to be heard at any time and in any forum, no matter what. There are times when lines can and must be drawn for reasons both moral and legal, but there are other times when it is inappropriate and wrong to draw such lines.
Mr Altaf Hussains needs to be responsible and cautious when expressing his views in public. Failing this the authorities are compelled to draw such lines.

I understand, the content of speech is inflammatory and Altaf is annoying, so what?
Free speech serves a very important purpose; it allows people to express their difference of opinion, no matter how differnt it maybe from general belief or ideology of a majority.
In addition, it sparks discussion which leads to a better and improved understanding perspectives, settle an argument and set new discourses of thought.
Banning someone to speak is tempting I see, but you CANNOT STOP EXPRESSION OF THOUGTS, NO MATTER HOW STUPID OR ANNOYING it may seem. Otherwise, lack of proper information exchange and ideas only breeds a consipiracy theory mind set.

I am not a MQM supporter, in fact I think 90% of Altaf's speeches are incoherent. But all who are supporting the ban on his freedom of speech, please quote what he said vs what Imran or Khawaja Asif or Zardari or for that matter several historians said and tell me why they all should not be banned along with Altaf? Double standards for patriotism have alleniated Balochistan and will alleniate other parts of Pakistan as well. Don't forget that MQM was born from the retaliation to the prejudice against urban Sindhi. If you want to get rid of MQM then make the urban population of Sindh believe that they are part of Pakistan and they don't need an ethnic representation. Last four months did not help this cause.

Opinion poll in Dawn newspaper is a domestic as well as international voting.Altaf speech mainly relate to grievances of MQM representing Urban Sindh from where they are the sole representative for last 30 years and this will only change on the wishes of area voter.It can be fairly assumed from the pattern of voting of nearly 25% of no votes that the Urban Sindh is with AH as the Urban Sindh population with MQM support is 10 to 12% of the Pakistan's population.So please give value to minority voice as once we have failed to listen to majority voice too.

Will the same court ban Khuwaja Asif, Asif Ali Zardari, Imran Khan and the Sharif's for the same offenses? The answer is "NO". This is where the problem arises different treatments and laws for so called son of the soil leaders.
I see comments regarding the percentage of votes on dawn's poll. Right now its 35 percent in favour of MQM. I am assuming this is predominantly vote from urban sindh. Against MQM is 65 percent. I am assuming that is predominantly rest of Pakistan. Even dawn polls shows that MQM enjoys overwhelming support in urban sindh. Rest we have seen in NA 246 who rules the hearts of people in urban sindh. MQM haters keep on dreaming. MQM is and will always be the first choice of urban sindh.

MQM haters check out the polls now. 41 percent in MQMs favour (and growing) and these votes are predominantly from urban sindh and from people who have technology and have no language barriers. Imagine the results if these factors were not involved. Any doubts who rules the hearts of people of urban sindh? If elections were not enough for some people to judge the popularity of MQM. All those so called educated illiterates commenting & bashing LHC decision and terming it Punjab dominance over other provinces seems to be unaware of the basic fact that a Pakistani can file a plea in any high court of Pakistan. In this case it was filed in LHC so obviously LHC was supposed to give its ruling over it. It wasn't a suo motto case anyway. If anyone has objection over similar speeches made by other politicians they can also file a case in any high court of Pakistan & get a ruling.

Majority of the Urdu speaking community in Sindh have not liked the infamous outburst. Calling RAW & NATO for help is unimaginable, it was a nightmare for all.

@Fakhir free speech is indeed a right but there should also be rules attached to it. In the US the example normally given is that you cannot stand up in a theatre and shout 'FIRE!!!' claiming that you are exercising your right to free speech.
The MQM leader has instigated number of problems with what you term as 'free speech'. Tomorrow the leaders of the banned parties and for that matter Taliban will want to really live speeches under the same guise. Careful what you ask for.

@Karim US unable to get your point. If a person shout Fire when there is a fire is it illegal? Even if it is otherway round your example didn't fit here because millions in Karachi believe that what AH is saying is worthy enough to listen. So the only option one has if he thinks AH is just speaking garbage is to use the same freedom of speech and explain his followers that why u think AH is misguided and they should not follow him.

I recollect a photo that appeared in Dawn years ago, with Mr. AH seated in a chair and showing off his UK Passport. It has remained a puzzle as to how a UK citizen is able to run the political show in Karachi and Pakistan.

On second thoughts -- Banning his speech , no matter how inflammatory , is not right. Its upto the people if they want to listen. MQM is a ligit party and as of now he is their leader. Its upto MQM and the people of Karachi to change the leadership if they wish so. I am not from karachi but their may be a reason people listen to him ( however irrational he may be sometimes ). I support his demand for a separate province or unit what ever you call it. Anti army or anti state speech -- remember recently zardaris rant against the army ?
To me PPP is way more corrupt / PMLN second -- and some lotas are spilling over in PTI now.
Altaf is there , yes -- there is no family politics in MQM , / i think.
We already saw a hint of family politics in PTI --

Altaf Hussain and his speeches are purely a political issue and if it has been brought before the court, the court should have shown restraint, instead joining the bandwagon to slap temporary ban on speeches of Altaf Hussain. Such a ban is not going to bring any positive result so far as tussle of MQM and Security forces is concerned. High Courts in the country are almost jam-packed with murder references, murder appeals, civil appeals, the Judges should concentrate to wipe the backlog of such substantial cases instead of wasting their valuable time and energy on political orientation cases.

Ban or no ban; both do not solve any problem. The real issue is politics on the ethnicity and language. Unless sind rises above the ethnic politics, all the problems including crimes will not go away. Urdu speaking will vote for MQM and sindhi speaking will vote for PPP and the rest making almost 33% of total population will have no representation. What developemnt or solutions can you expec in this scenario?
