LAHORE: Chairman Pakistan Cricket Board (PCB) Shaharyar Khan on Monday said that the board had signed a proper contract with Board of Control for Cricket in India (BCCI) in 2014 as a result of which the PCB had favoured India while supporting the now defunct Big Three formula, and it was not just an MoU for the resumption of bilateral series between the two countries.
“We have received a reply from the BCCI about our notice sent to them for not fulfilling the contract and because of it the PCB has suffered huge financial losses.
The BCCI’s reply has two objections,” Shaharyar told Dawn from Karachi. “Firstly, there is no term is included in the contract under which the word of government’s permission is mentioned as necessary. Secondly, it was not an MoU but a contract as India sought PCB’s support for the Big Three formula, from which it earned huge revenue as a member of Big Three.
“Our benefit was only if the bilateral series would have started, which could not be happened, causing us massive losses.
“Our legal team has prepared the case on strong footings and now we will again send a response to the BCCI’s letter before moving to the ICC dispute resolve committee.”
Elaborating further, the PCB chief said: “Let me clear that the PCB’s case is strong and we will go to the last stage to win at the ICC level since it is our right to demand justice.”
Last week, the PCB had sent a notice to BCCI, seeking claims reportedly of $6.4 million for India’s refusal to honour the contract, which was signed three years ago. “It is not our [government] but the Indian government which is creating hurdles in the way of resumption of bilateral cricket and as that term related to the government’s permission is not included in the contract, so, it is not our responsibility to get permission from the Indian government,” he said.
Both the countries have not played bilateral cricket since 2007 when Pakistan visited India for a full series.
Meanwhile, Shaharyar said he was on a three-day visit to Karachi to have talks with high-ups including Sindh chief minister, chief secretary and DG Rangers Sindh on resumption of international cricket in the city.
“We are expecting some international cricket in near future and we also want to hold some matches in Karachi for which detailed meetings with the high-ups of Sindh government are necessary,” Shaharyar said.

A contract can gain or loose its currency on account of the prevailing situations/circumstances of its implementation and can be revisited for amendments or abrogation or put on hold indefinitely. As the situation in Pakistan is not favorable for any cricket or hockey or any other discipline of the sport,PCB is free to take it to ICC or where ever they choose too. Hence even if PCB claims to have entered into a contract with BCCI then why forget that ICC will play blind to the situation in Pakistan.

Pakistan should stop being desperate for India Pakistan series, India on many forums has humiliated Pakistan, be it in sports, on diplomatic front etc etc and one should not eclectic any change of status quo with this BJP government and rising fanaticsm in India. Pakistan - India matches are always a thriller but our country self esteem is more important.
Even if Pakistan goes to India, can they play???? Similarly as BD is following India lines, same is the case with BD and stop requesting them too.

Dear Khan Sahab, I have never met a lawyer who says you don't have a case.
After 3-4 fees payments later ,they open up.
Please check the documents your self before making tall claims.BCCI wont dare reply in media if you have a strong case, if you had a strong case, you should have not waited so long.
This will hurt the case.

The MOU/Contract was signed by BCCI with PCB on condition that they support the BIG 3. But since now they have opposed it, and the BIG 3 no longer exists, PCB has no moral and legal right to sue BCCI and ask for compensation. Thanks.

It's time for Pakistan to put its resources and energy if football rather than cricket. Just like hockey lost its glory, cricket was bound to lose its own someday. We can't continue to follow or try to revive a dead sport but we can introduce a sport which will not only raise interest of people in sports but also get everyone involved especially children from disturbed neighbourhoods. Not every child can afford a cricket kit but football it's pure skill and a ball. If rashid Latif admitted this on one of his shows and clearly stated "ab football ko aa jana chaheeay Pakistan main" cricket was the game of rich people and now it has become a game of rich countries; poor countries are just a puppet show. Thank God we managed to win some big trophies against all odds now time to move on to another.

Whem Mr Sethi signed these agreements he was asked many a times that what if India do not agree to play. The anchor kept asking him and Sethi kept saying that there is no question of India not playing. Now Sethi is into hiding and you at the age of 84 have to defend him. You are a seasoned diplomat. I urged you to take full control or step down dont be a burden on PCB or Pakistan

@Aamir, I believe you are mistaken. BD wants to play with Pakistan anywhere in the world except in Pakistan. India, however, does not want to play with Pakistan at all. Also no other cricketing nation wants to visit Pakistan at this stage and I am not sure why Pakistan is forcing BD to visit Pakistan.

Quid pro quo is an essential element of a contract regardless of it being an MoU or written on a napkin. In this case, I can see both parties benefiting so PCB can surely proves the legality of this as a contract

Of course the "movers and shakers" in New Delhi who have a penchant to mix sports with politics are saying just the opposite of what PCB chair says. In fact, they have publicly said that the MOU singed with PCB was not a biding document.Therefore the best bet to resolve this crucial issue between the two countries is through the international court of sports arbitration (ICAS) based in Lausanne, Switzerland, also known as the "Supreme Court of Sports" in the civilized world. In essence, ICAS is a global quasi-judicial body created to settle sports dispute in the world through arbitration and its decisions could only be challenged in the Federal Supreme Court of Switzerland.
Let PCB immediately file a case with ICSA against the BCCI for violating their MOU & also make the "movers and shakers" in New Delhi as co-defendants for mixing sports with politics & violating the real spirit of democracy in sports by subjugating the right of freedom of choice for all of its sportsmen and women.

Everybody is missing the point here. Normally in a calendar year there could be possible only one tour with each country. Which means in six years there could be only 6 series possible. But India promised we will return the favour of your support for big3, with 2 additional tours within the 6 year span making it a total of 8 series. Government approval seeking, is implied for all bilateral tours. If it is an ICC tournament governments should not disapprove participation because it will invite penalties. This is only a bilateral tour and not ICC tour.

Does Mr Khan know the difference between MoU and contract? I actually have my doubts. He should confirm with an international lawyer because I don't think any Pakistani lawyer may have the necessary expertise and experience to determine the correct status of the document signed.
