A couple from Multan moved the Lahore High Court (LHC) on Tuesday, seeking protection against a panchayat which had reportedly forced the couple into a divorce.
Submitting an affidavit rejecting the decision of the panchayat, Uzma Batool said that she had married Mohammad Adnan of her own accord but a panchayat comprising family members of Batool and Adnan had forced Adnan to divorce her on gunpoint.
The couple has, through the petition, claimed that they are being threatened for remaining in contact and require protection. Adnan has also submitted an application, seeking protection, with local police in Muzaffarabad Town near Multan.

The point is, that while in Islam it is mandatory that the consent of the female and male are taken before proceeding for Nikah. At the same time the Nikah of the female cannot be established without the consent of walee, which is Father, Grand Father, Uncles and brothers. Otherwise the Nikah on her own is not established islamilcally.
Regardless of the silly procedure or rulling of panchayat. The Nikah was never established at all.. This point should not be ignored too. Otherwise the status of this union shall be livein couple per Islam.
Someone may debate of court marriage or state intervention to establish and may bring some limited interpretation of Hanafi school of thought, To remember is that Sahih Hadidht does not provide the allowance of Nikah without the consent of Walee, secondly Jamhoor/majority overrules and the understanding shared above is majority of schools..

Now for them to gat married again ,I believe she will have to marry someone else,be consumed ,get divorced from him and then only can marry this man again.
