PESHAWAR, Jan 24: A two-member bench of the Peshawar High Court delayed on Thursday for a single day announcement of its verdict in a writ petition challenging the detention of Jamiat Ulema-i-Islam after the NWFP advocate-general sought time for submitting further documents before the court.
The bench, comprising Justice Tariq Pervaiz and Justice Abdur Rauf Laghmani, was informed by Advocate-General Qazi Rasheedul Haq that there were some more documents on the basis of which the Maulana had been detained.
The officials in D.I.Khan, native town of the detainee, had a number of documents showing direct involvement of the detainee in the activities prejudicial to public peace, he claimed.
The bench observed that habeas corpus were important in nature and irrespective of whether Maulana Fazlur Rehman or x,y or z was in detention so much time could not be given.
The bench further observed that on Jan 16 one week’s time was given to the government and now when the date was fixed for the pronouncement of the verdict the advocate-general had once again been seeking time for submitting more documents.
Advocate Essa Khan, appearing for the petitioner Sahibzada Khalid Ahmad Benori, provincial vice chief of the party, stated that the advocate-general had adopted a novel way of delaying the matter.
