PESHAWAR: A local court on Thursday acquitted an accused arrested on charges of killing his wife over a domestic dispute last year.

The additional district and sessions judge, Ijazur Rehman Qazi, ruled that the prosecution could not prove its case against the accused, Syed Qayyum, a resident of Jehangirabad, Peshawar.

The judge accepted an application filed by the accused under section 265-K of the Code of Criminal Procedure, which empowers a trial court to acquit an accused before conclusion of trial if there was no possibility of his conviction on the basis of available evidence.

Advocate Abdur Rehman appeared for the accused and stated that his client was charged in an FIR registered at police station Shahpur in Peshawar on May 31, 2023.

He stated that the complainant in the FIR was Ghaniur Rehman, brother of the deceased woman named Shamim, who had told the police at a hospital that his sister was married to the accused.

He stated that the complainant had alleged that he came to know that his sister was killed by her husband by hitting a brick on her head.

The counsel contended that apart from the statement of the complainant there was not a single evidence against the accused.

He contended that there was no eyewitness to the occurrence and his client was falsely implicated in the instant case.
