SUKKUR, April 29: The division bench of the Sindh High Court, Sukkur, has issued notices to government functionaries and a builder to appear in the court on May 16 regarding a housing scheme which a petitioner said had been started without going through set procedures.

The bench comprising Justice Zia Pervaiz and Justice Ameer Hani Muslim issued notices on Friday following a public interest petition filed by a lawyer Ghulam Mohammad Durrani.

Mr Durrani said in the petition that Arif Builders who had advertised a housing scheme adjacent to Sukkur airport some time back, started booking for bungalows but according to information they were issuing the buyers only receipts of payments and not a standard agreement signed between them.

He said there should be an agreement between the builders and developers as well as the owners of the land to avoid any dispute in future among the parties.

The builder was required to get a no-objection certificate (NoC) from the TMO Sukkur, and another NoC from the Civil Aviation Authority as the area was adjacent to the airport.

Besides, he should have registered with concerned authorities, entered into an agreement with the owners of the land in question, and registered with and got converted the agricultural land into sikkni, Mr Durrani argued.

On this the division bench issued notices to Government of Sindh, DCO Sukkur, district nazim Sukkur, taluka nazim New City Sukkur, EDO revenue Sukkur, DDO revenue taluka New City Sukkur, Mukhtiarkar revenue taluka New City Sukkur, registrar Cooperative Housing Societies Sukkur, Civil Aviation Authority Sukkur and Messer Arif Builders and Developers to appear in court on May 16.

INJURED: Malir DSP Asghar Pathan was injured seriously by armed men near Wakar village in the Garhi Yasin police area of the Shikarpur district on Saturday morning.

According to police sources, Asghar Pathan was on way to Jacobabad to attend court when reached near the village, a group of armed men, who were hiding in the bushes, opened indiscriminate firing on him.

As a result, he was injured seriously while the attackers fled from the scene.

The injured was admitted to the Shikarpur civil hospital and after providing medical treatment he was shifted to a Karachi hospital.

Amjad Pathan, brother of Asghar Pathan registered an FIR against Shaaban Odho, Rasheed Odho, Zulfiqar Odho, Lutufullah Odho, Qamar Din Odho, Shaman Odho, Hussain Odho and three unknown.

The cause behind the attack was said to be an old enmity.
