HYDERABAD, June 9: The Hyderabad circuit bench of the Sindh High Court on Friday issued show-cause notices to EDO and DO (education) Umerkot while initiating contempt of court proceedings against them.

The court took notice of their absence and observed that both the officials did not bother to appear and, instead sent a clerk of their office.

The court asked in the notice why contempt of court proceedings should not be initiated against them for deliberate non-compliance of their own undertaking.

They have been given one-month time to submit their reply and ordered that cheques of petitioners should also be deposited with the additional registrar of the court.

Petitioners Chettan Kumar, Aqeela Khanum, Arifa Durrani, Urmela Devi and Vidviyas had urged that their salary was stopped by the respondents though they continued performing their duty.

They said that they had filed departmental appeals for release of their salary and then filed appeal before the Sindh Services Tribunal after statutory delay in Karachi.

They said that the tribunal allowed their appeals while directing respondents to release salary of petitioners.

They said that in spite of a lapse of more than 90 days of receiving the judgement of tribunal respondents did not comply with the order of tribunal.

They said that the respondents were legally required to comply with the order.

They prayed the court to direct the respondents to implement the tribunal’s judgement in their appeals and release salary to them.

In their para-wise comments, the EDO and DO education said that petitioners had obtained judgement from tribunal fraudulently and without any documentary proof and that Arifa Durrani never worked as a high school teacher in sub-division nor she performed duty in girls middle school and her name is not available in school muster roll hence she was not entitled to salary.

On May 3, both the respondents apologised for making certain observations in respect of judgement passed by service tribunal and they were admonished by court not to repeat such act in future.

The EDO education, who was present on the occasion, undertook to comply with orders within one week and the court granted two weeks grace time for compliance.

The additional advocate-general of Sindh, Masood A. Noorani had informed the court that steps were being taken by respondents to implement the judgement on the priority basis.

NOTICES: The court also issued notices to the DPO Tharprkar and Nagar Parkar SHO for June 19 on a petition alleging police high-handedness.

Petitioner Adam Halepoto said that his relative Chanesar had married Muneran in 2004 and they were living a happy matrimonial life.

They shifted to somewhere and the petitioner and his other relatives had no knowledge of it, he said.

He said that the SHO along with police raided the village and his house and arrested villagers, Sonharo, Lakho, Ali, Habib and Misri.

He said that except for Lakho, the petitioner and other villagers were released after payment of illegal gratification and added that Lakho was in illegal detention without registration of any case.
