HYDERABAD, June 21: Mr.Justice Amir Hani Muslim of Sindh High Court Hyderabad circuit bench on Wednesday ordered District and Sessions Judge Hyderabad to conduct an inquiry into wrongful detention of two persons.
The inquiry shall be completed within four weeks and report would be submitted before the court.
An identical order was passed on two separate constitutional petitions, filed by Beerbal and Piaro regarding illegal detentions of Ibrahim and Jumo, seeking registration of FIR against policemen, who kept them in illegal detention and subjected them to torture. The detainees also filed their affidavits before the court which were taken on record and the court ordered judicial inquiry by sessions judge.
Mehran Khaskheli, SHO police station Sinjhoro, Mehar Waris, In-charge investigation team Sinjhoro, Abid Hussain Qaimkhani, DSP headquarters Sanghar and Sujan Singh, DSP (under suspension) headquarters Sanghar were cited as respondents.
According to affidavit submitted to the court by Jumo, the son of petitioner, Beerbal, the respondents forcibly entered the village and illegally arrested him along with many others on February 8 and kept him at unknown place.
The same day a police team raided houses and arrested Ibrahim Machi, Arjan Bheel, Allah Bux Mari, Munawar Ali Chandi, Motki Kolhi and eight other persons in a case related with kidnapping of Muno Bheel's family members. Police, however, arrested Jumo and confined him wrongfully.
He said he was detained at various police stations and was shifted from one place to another along with Ibrahim Machi, Kamdar and others since February 8 without any reason or involvement in the case.
He said that respondents after arresting him and Ibrahim produced them on March 22 for obtaining remand in crime no 35/98 under sections 365, 34 PPC by DSP Abid Hussain Kaimkhani. 1He said, they were remanded to judicial custody for six days. They said they were shown arrested on March 21. They said it would not be out of place to mention that he was not produced before any magistrate and kept blind folded, beaten and tortured by respondent policemen to an extent that he couldn't walk.
He said he and Ibrahim received injuries and then they were referred for medical treatment.
In his main petition, Beerbal said that a special team, formed under of apex court, consisting of respondent policemen entered his village and arrested many persons on February 8 and kept them at unknown place.
He said he came to know that his son, Jumo and Ibrahim were tortured and forced to make statement against Abdul Rehman Mari, who is facing trial in case of abduction of Muno Bheel's family members. He said the businessmen and villagers protested against arrests and special team formed by PPO Sindh. There was strike in village against arrests.
He said that he met his father in the court when supplementary challan was submitted before Additional Sessions Judge-I against Jumo Bheel along with Ibrahim Machi. He approached SHO police station Jhol for registration of FIR against policemen but he refused to do so.
