ISLAMABAD, July 30: The Supreme Court on Monday issued notices to the attorney-general and the special prosecutor-general for Wednesday in a review petition filed by Alliance for Restoration of Democracy (ARD) president Makhdoom Javed Hashmi against his conviction and non-entitlement of remission in jail term.

A three-member bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Rana Bhagwandas and Justice Faqir Mohammad Khokhar was informed that Makhdoom Hashmi had completed his seven-year jail term after the grant of possible remission in sentence, but the jail superintendent opposed this on the grounds that since the convict was involved in a mutiny case he was not entitled to any remission. Therefore, his date of release is November 11, 2010.

Advocate Mohammad Akram Sheikh, legal counsel for Javed Hashmi, produced before the bench a letter of the superintendent of the Central Jail Lahore stating that Makhdoom Hashmi was involved in the serious crime and could not be given the benefit of remission.

“Had my client given the benefit of remission, he would have come out of dungeon now,” the counsel said.

At this, the chief justice observed that the case seemed genuine, but decided to issue notices to the attorney general and the prosecutor general.
