LARKANA, Aug 23: The Larkana circuit bench of the Sindh High Court on Thursday ordered the District Police Officer (DPO) of Kashmore, Noor Ahmed Paichoho, to deposit Rs100,000 with the court as compensation for keeping two persons in illegal confinement.
The division bench comprising Mr Justice Amir Hani Muslim and Mr Justice Syed Sajjad Ali Shah directed the DPO who had appeared along with TPO and SHO of RD-109 police station to deposit the money within five days with the court’s additional registrar and return within two days three weapons and a mobile police had taken away during raid on the house of the petitioner, Mohammed Yousuf Jatoi.
The court also asked the police not to harass the petitioner and the detainees, Sabir Hussain and Mohammed Ali, who were also present at the hearing.
The detainees said in their statement that police had taken away three weapons but the DPO insisted that only two weapons were in police’s possession.
They said that they had licenses of two weapons and one
was with the police and claimed that they had been kept in wrongful confinement for 17 days while the DPO said that police had kept them for 10 days only.
Police had raided the petitioner’s house and arrested Sabir Hussain and Mohammed Ali even though they had been restrained on Aug 16 from arresting the two who were nominated in a false FIR.
The petitioner had told the court that police registered a false case of kidnapping against his brother, Zulfikar Ali, Tahir and Sabir Hussain after he solemnised marriage with Ms Fozia Soomro in court.
Mr Yousuf filed an urgent application on Aug 20 informing the court that police had picked the two against its orders and kept them in illegal detention at Qilla Mir Jan police post of RD-109 police station.
The court sent a raid commissioner to the police post on Aug 20 who found the two detained there in fetters. The post in-charge told him that ASI Mohammed Nawaz Chachar had brought them to the post and there was no entry against them.
The SHO of RD-109 police station along with the in-charge of police post appeared on Wednesday before the divi-
sion bench with the two de-
tainees who said in their statements that police had arrested them.
They said that after their arrest the DPO of Kashmore tortured them at his house and later they were moved to Qilla Mir Jan police post.
