HYDERABAD, Aug 27: The Hyderabad circuit bench of the Sindh High Court on Monday stayed the Aug 21 order passed by the additional sessions judge-I of Hyderabad directing Matiari police to lodge an FIR against district nazim, his father, DPO and SHO of Matiari while the same ADJ-I granted bail to 15 people who were accused of attacking a police party.
Justice Mrs. Yasmin Abbasey of the SHC passed the order on a criminal miscellaneous application filed by Matiari District Nazim Mohammad Ali Shah Jamote, his father Zulfikar Ali Shah Jamote and Haji Gul Hassan Sand and adjourned the case to a date to be fixed later on by the court’s office.
The applicant’s counsel said that the ADJ-I had ordered registration of FIR against the applicants without considering ground realities. In fact police had gone to arrest Pir Ghulam Mujaddid Sarhandi and his companions who were wanted in a case of robbery, he said.
He said that when the police reached there they attacked them and opened fire on them. Police subsequently called reinforcements and then arrested around 10 persons who were found in possession of illicit weapons and were involved in different cases including police encounter.
He said that to avoid arrest and investigation they filed an application at the sessions’ court seeking registration of FIR against the applicants, which led to ADJ-I Hyderabad ordering registration of FIR on Aug 21 without considering related grounds.
Meanwhile, ADJ-I of Hyderabad on Monday granted bail to 15 Sarhandis accused of attacking the police party on Aug 21 for a sum of Rs50,000 each.
Their counsel argued that police had implicated them in a criminal case and reminded the court that it had itself ordered registration of FIR against district nazim and DPO of Matiari on a human rights application by Ghulam Mujaddid Sarhandi.
He said that after the order the Sarhandis’ opponents attacked them at their residence in Matiari and alleged that police had committed robbery in their residence.
