LAHORE, Oct 11: The counsel for the Pakistan Lawyers Forum has written a letter to the chief justice of Pakistan to constitute and head a full bench for deciding whether or not the apex court would keep alive the doctrine of necessity and provide the military an excuse for future adventures.

“Sitting in the bar association at Lahore, I was surprised to note that the lawyers are frustrated on account of the absence of your good-self from the cases which were heard at Islamabad lately and were so important that the fate of the entire nation rested upon them,” said AK Dogar, the PLF counsel.

“I think it is the constitutional duty of the chief justice of every country that he must sit in the largest bench to decide the destiny of the present as well as future generations. I for one feel that if the learned chief justice abstains from taking decision for such important constitutional questions as the separation of army form politics, to examine whether the chief of army staff while in office can be allowed to be a candidate for the office of the president, whether the disqualification provided under Article 43, 63 and 244 debars the chief of army staff from taking part in any political activity whatsoever,” the lawyer wrote.

“All these constitutional questions need the application of judicial mind of the chief justice himself. I am sure that if your good-self has chosen not to sit to decide the above questions of great importance, you are failing in your duty to the people of this country”, he added.—Reporter
