HYDERABAD: Notices issued to builders

HYDERABAD, Oct 20: The Hyderabad circuit bench of the Sindh High Court has issued notices to two builders who had converted space reserved for parking lot or basement into shops.

The court asked the petitioner, Ikramuddin, general secretary of Hyderabad Electronics Dealers Association, to provide complete addresses of the two builders, after converting his handwritten application into a constitutional petition in January.

The court had a detailed inspection of six plazas named in the application conducted by Additional Advocate General (AAG) Sindh Masood A. Noorani.

The six plazas were Ghousia Centre, Allahwala Centre, Rahat Cinema Road, Digital Centre, Rahat Cinema (under-construction), Ahmed Khan Centre near St. Bonaventure’s School and Macca Tower near Station Road.

The court had passed an interim order restraining the projects’ builders from raising any construction.

When the matter again came up for hearing on Oct 18 the bench noted that the basic point in the case was whether the basement or parking lot was meant for sale by builder or owner to prospective purchasers, independent of the sale of upper storey flats or shops or whether sale of upper storey premise was connected with basement and parking lot and that each of purchasers was entitled to use parking lot for individual purposes.

The court in its April 5 order had called for removal of all the unauthorised construction raised over the basement of Ghousia Electronics Centre off Station Road and asked the Hyderabad Development Authority (HDA) to show cause as to why costs for restoration of parking space might not be recovered from the delinquent officers and HDA and compensation awarded to affected persons.

Mr. Jhematmal Jethanand advocate who was representing the authority undertook to file a sanction letter whereby the building had been approved by the HDA.
