HYDERABAD, March 10: The Sindh High Court, Hyderabad circuit bench, here on Monday restrained respondent Hesco officials from announcing results of interviews held for the post of revenue officers till March 25, although they may continue the process otherwise.

The order was passed on a stay application, filed by Jalaluddin Rajput, a lower division clerk (LDC) in Hesco.

His two contempt of court applications are also pending hearing before the court which filed for violation of previous high court’s orders.

In his petition, he maintained that he had passed written test of revenue officer on April 14, 2003.

He applied for RO before the Chief Executive Hesco on May 24, 2003, on the basis of merits but it was not entertained though several posts were lying vacant. He claimed he qualified to be appointed as RO after having passed the test. However, he was not appointed.

He filed an appeal before the Chairman of Wapda which was forwarded to the CE of Hesco but it was again not considered and after two years the CE informed him that no posts were vacant and he could not be appointed as RO while during pendency of his appeal appointments were made.

He then filed an appeal before Federal Ombudsman but his grievance was not redressed.

He prayed the court to declare action of respondents for not considering and determining fitness of petitioner as illegal. He said respondents should be directed to consider his appeal pending before them.

Through an ordered on Feb 15, 2007, the court had disposed of the petition after respondents submitted that representation of petitioner would be disposed of on merits and if petitioner applied for the post his application would be entertained.

The court asked respondents to dispose of his representation in two months and his application for RO shall be entertained on merits as per rules.

The petitioner filed a contempt of court application before the court, stating that Khwaja Maqbool Ahmed, the then CE of Hesco, violated the court order and he was informed that his representation/appeal has been disposed of which clearly proved the disobedience of court. He said he was asked not to make any unnecessary correspondence.

The petitioner filed a separate contempt of court application against Zafar Iqbal Awan, the director of administration and human resources, praying the court to issue injunctions against him and restrain him from appointing RO till disposal of his earlier application which is filed against CE Khawaja Maqbool Ahmed.

He argued that respondents have invited applications for the posts of RO despite having knowledge of court’s order dated Feb 15, 2007, and added that respondents have failed to announce result of test which he had passed successfully for the post.

The court had issued notice on this application but the petition was not taken up for hearing because of non-availability of division bench.

He filed a stay application after publication of advertisement for the post of RO whose written test was held on February 9 and interviews were held on March 5.

He prayed the court to restrain respondents from announcing the results of interviews.
