KARACHI, July 14: Addition-al district and sessions judge-VII, South, Irfan Hussain Siddiqui on Monday dismissed as not maintainable an application filed by an individual against the deposed chief justice of Pakistan, Justice Iftikhar Mohammad Chaudhry.

The applicant, Maulvi Iqbal Haider had filed his plea under Section 22-A of the Criminal Procedure Code alleging that Justice Chaudhry had illegally obtained a plot from the Federal Government Employees Housing Foundation in July 2006, and maintained that the act had caused heavy financial losses to the national exchequer.

The applicant had sought the court’s order directing the police station concerned to register an FIR against the judge.

Deputy district attorney Abdul Maaroof argued that the applicant did not provide any evidence to substantiate his allegation.

The counsel told the court that the applicant’s allegation was aimed at damaging Justice Chaudhry’s reputation. He prayed to the court to dismiss the application since it was not maintainable.

Warrants out

Civil judge and judicial magistrate, South, Naheed Jabbar on Monday issued non-bailable warrants for the arrest of sub-inspector Mohammad Ali, head-constable Sabir Hussain and assistant sub-inspectors Mohammad Nadeem and Ghulam Mustafa for not appearing in the court despite being served notices to testify in a robbery case.

The case was registered by the Anti-Car Lifting Cell against an accused, Mohammad Amin.

The court fixed August 9 as the next date of hearing.
