HYDERABAD, Jan 6: Tando Allahyar District Nazim Dr Rahila Gul Magsi requested the additional district judge-III on Tuesday to transfer her case from Tando Allahyar police station to some honest officer of Hyderabad or Matiari police and the judge sought record from her counsel, validating the request.

Ms Magsi had first filed an application through Ayatullah Khwaja advocate in the court of sessions judge who had ordered police to register an FIR against a PPP MPA, DCO, DPO of Tando Allahyar and others on charges of criminal trespass into the nazim’s office in her absence when police had refused to file her case against the highly influential people.

The case was transferred to ADJ-III after police sought cancellation of the FIR.

She cited DIG of police Hyderabad, SP investigation and SPO Tando Allahyar as respondents in her application and the court adjourned its hearing to Jan 10.

The investigating officer of the case, Mir Mohammad Bachal, informed the court that police had submitted a report to the civil judge concerned and judicial magistrate of Tando Allahyar, seeking cancellation of the FIR on grounds that no such incident had in fact taken place as alleged by the applicant.

The district nazim stated that on Nov 19, 2008 an FIR was lodged against PPP MPA Imdad Pitafi, DCO Tando Allahyar Pervez Ahmed Sehar, DPO Imtiaz Tunio, PPP leaders Sattar Bachani and Zulfikar Sattar Bachani and others on the orders of ADJ-III when police refused to lodge the FIR on her complaint.

She said that she feared she would not get justice, therefore, she sent applications to provincial police officer (PPO) of Sindh, additional IG (investigations) and sessions judge of Hyderabad, requesting for impartial investigation through an honest police officer of some other district because the nominated accused were highly influential people.

They would use their influence to deny her justice during investigation of the case as the police were not ready to take any action against them, the FIR would be disposed of and the accused might file false criminal cases against the applicant, she said.

She said that police had not taken any action ever since she lodged the case except for contriving excuses to dispose of the FIR and prayed the court to transfer the FIR to SP CID, DPOs (operations) of Hyderabad or Matiari. Tando Allahyar police lodged the case against the accused on charges that they had issued threats to her and forcibly occupied her office in the district government secretariat when she was not present there.

She claimed that the trespassers took away her important documents.
