HYDERABAD, May 11: The Sindh High Court, Hyderabad circuit bench, on Tuesday sent an election petition of People's Party Parliamentarians' defeated candidate against Muttahida Qaumi Movement's minority MNA Devdas to the Chief Election Commissioner for disposal.

The PPP candidate, Dr Mahesh Kumar, had stated in the petition under the relevant laws, the reserved seats were to be filled through proportional representation system on the basis of general seats won by each political party.

D Kumar said that according to the National Assembly and Provincial Assemblies Allocation of Reserved Seats for Women and Non-Muslims (procedure) Rules, 2002, seats won by independents candidates and more than one general seat won by a nominee of a political party were to be excluded from the total number of general seats in the NA for determining the share of a political party.

However, he said that the Election Commission did not exclude the 26 dual seats which reduced the share of his party from three to two seats and the EC declared Mr Devdas successful though his party was not entitled to any reserved seat as it had won only 13 general seats.

The petitioner said that the Election Commission did not determine the share of each political party in accordance with rules on his request.
