HYDERABAD, April 1 Sindh High Court Hyderabad circuit bench comprising Justice Amir Hani Muslim and Justice M Iqbal Maher here on Wednesday ordered Director Planning and Development Control Hyderabad Development Authorities (HDA) and other officials to maintain status quo till April 14 regarding widening of a road.
The court issued notices to respondents and asked the official, who has issued notices to petitioner, to appear in person along with papers of scheme regarding widening of road.
The order was passed on a petition filed by Dhoraji Memon Cooperative Housing Society through its general secretary Mohammad Aslam and Zulekha Wali Mohammad Rangoon wala Trust through its in-charge Zakria Daiwani.
The Director Planning and Development Control, administrative officer to District Nazim Hyderabad, Director Building Control, EDO revenue, deputy district officer (revenue), Taluka Municipal Administration (TMA) Qasimabad, Senior Member Board of Revenue, Mukhtiarkar Revenue are cited as respondents.
The petitioners claimed that they are registered cooperative societies and had built flats for their members and others within their community having total area of 5-27 acres. There are plots bearing no 31 to 34 facing road side and plot no 3 and 5 is the Rangoonwala Community Centre.
They said that a flyover was being built over Wadhu Wah at Poly Technic Road and is so defective that it has totally stopped smooth flow of traffic to Qasimabad and has also stopped the main entrance of Qasimabad Road.
They informed hat they are owners of above-mentioned plots where a water tank existed for supply of water to owners of flats in the cooperative society, a mosque, madressah, hospital, watchman room office, computer centre for children, a community centre for girls commonly known as Rangoonwala where more than 800 girls are getting vocational education.
They said that respondent HDA`s director planning and development through a letter dated March 18 issued notices to petitioners, mentioning that Hyderabad district government is executing work for widening of road of former National Highway and during their visit legal ownership and construction is shown as encroached area without considering their own approved permission and map. The respondents asked petitioners to dismantle legal construction without observing legal formalities.
They said that construction of flyover is defective one and without proper planning. They said that respondents are asking for 50 feet area which would leave no space for their mosque, hospital, water tank, etc.
