ISLAMABAD, July 29: The sessions judge of Mianwali has informed the Supreme Court that no formal application had been submitted for a compromise deal between the two parties of Abbakhel under the Qisas law.

The sessions judge informed the apex court, which had taken suo motu notice of the out-of-court deal, that he had recorded the statements of 10 people, including two girls who had been given to the complainant party for effecting the compromise.

The complainant party’s head, Atta Mohammad Khan, stated before the sessions judge that his age was 71, and not 80 as was reported in the press.

Mehr Khan, the other member of the complainant party, who had contracted marriage with 14-year-old Tasleema, also clarified that his age was 45, and not 55 as reported. They said that they had demanded six minor girls as part of the deal only to “pressure” the other party.

They informed the judge that Rs8 million, which was to be paid to them under the deal, had not been received so far. Both Atta Khan and Mehr Khan stated that they had, on the insistence of their biradri, divorced Waziraan and Tasleema.

The court recorded the statements of Atta Mohammad Khan, Mehr Khan, Ghulam Rasool, Hameedullah Khan, Mohammad Aslam Khan, Bahadur Khan, Imtiazullah, Mohammad Abdullah, Mumtaz Waziraan, and Tasleema.

Chief Justice Shaikh Riaz Ahmad, in its suo motu order on Wednesday, had ruled: “The compromise deal as reported in the press, prima facie, appears to have been reached in violation of the law of the land and against the norms of the civilized world”.
