KARACHI, Nov 26 The Sindh High Court on Thursday ordered publication of a notice in some UK-based newspapers to summon former president Gen (retd) Pervez Musharraf for hearing of a petition seeking registration of a treason case against him.

A division bench, headed by Chief Justice Sarmad Jalal Osmany, said it was a well-known fact that Gen Musharraf was living in the UK.

“Let publication of notice be made in widely circulated newspapers in the UK,” the bench ordered.

Petitioner Maulvi Iqbal Haider told the court that notices were not being received at former president's residence in Chak Shahzad and report of disobedience had also come.

He said that the case was earlier fixed for Oct 10 but it could not proceed because the notices could not be served on the former president.

He urged the court to issue necessary orders for publication of the notice against Gen Musharraf because several attempts had been made by the ordinary mode of service, but the notice could not be served.

Maulvi Haider said in his constitutional petition being heard since March 28 that Pervez Musharraf had violated his oath of office and overthrown an elected government.

He suspended the Constitution twice and made amendments according to his own will. Therefore, a treason case should be filed against him, the petition stated.

The petition seeks trial of the former president and his allies Sharifuddin Pirzada and Malik Qayyum on charges of “high treason” for abrogation and subversion of the Constitution of 1973, either by proclaiming or assisting in the proclamation of “Provisional Constitution Order (PCO 2 of 2007)”.
