PESHAWAR, Aug 8: A single bench of the Peshawar High Court on Thursday turned down bail petition of a person accused of killing his wife.
The bench presided over by the Chief Justice Mian Shakirullah Jan ruled that the deceased woman had died during the presence of the accused and the medical report did not support the accused version that the deceased had committed suicide.
The accused, Sirajul Haq, resident of Kathozai, had reported to the police station Shabqadar on Dec 8, 2001, that his wife, Naseem committed suicide by firing two shots on herself with a Kalashnikov. One week after her death, father of the deceased, Marifullah, charged the accused of killing his daughter. He stated that one week before the occurrence exchange of hot words had taken place between the accused and the deceased over a domestic dispute.
The bail petition of the accused was earlier rejected by the concerned district and sessions judge. The judge had ruled that if she had committed suicide then there should have been one bullet wound on her body. In case of two shots, he ruled, the bullet entry points should have been at the same spot in case of suicide, but in the instant case the entry points were at different spots.
The accused had claimed that he was present at the time of occurrence when his wife shot at herself. His counsel contended that he was falsely implicated in the instant case. He argued that there was no eyewitness who could support the prosecution version of the story.
