LARKANA, July 26 Mr Justice Salman Hamid of the Sindh High Court, Larkana circuit bench, stayed the implementation and operation of recommendations of the selection committee of Shaheed Mohtrma Benazir Bhutto Medical University (SMBBMU) Larkana, regarding appointment of associate professors, assistant professors and senior registrars in different departments.

The court passed the order on a petition filed Dr Shahida Shaikh challenging the recommendations of the selection committee which had finalised its recommendations on July 3, 2010.

Ghulam Dastgir Shahani advocate, counsel for the petitioner, said that being eligible, she had applied for the post of assistant professor and Syed Imtiaz Shah, Dean Faculty of Surgery and Allied, was included in the selection committee against whom she had complained of indecent attitude in 2008. She apprehended that he would not act fairly due to which she would not be able to get fair justice. She appeared for interview and to her utter surprise a tentative list was issued by the university showing junior most lady doctors' names that misrepresented with the claim of preferential right.

It was illegal and against the terms and conditions of the advertisement and the charter of the university, the advocate said.

He said that the committee was not constituted in accordance with the laws and decision of such a committee merits no consideration adding that the petitioner was senior amongst all candidates in professional field by virtue of her appointment and experience.

The petitioner said that the impugned tentative recommendation list was issued in collusion with each other in order to oblige politically-backed persons and the relatives nominated in the selection board.

The selection board, in its meeting held on July 3, had recommended appointment of one associate professor in neuro-medicine, two assistant professors in neuro-surgery, four assistant professor in gyneacology and obstetrics, three assistant professors in ophthalmology, three assistant professors in urology and three senior registrars in gyneacology and obstetrics.

The petitioner prayed the court to order that the selection board was constituted against the charter of SMBBMU, cancellation of the tentative merit list (recommendations) made on July 3.

It also prayed for suspending the implementation, operation of the tentative impugned recommendation. The SMBBMU and its VC should be restrained from issuing appointment orders at this stage during the pendency of the petition. The hearing of the petition was adjourned to a date in office.
