PESHAWAR, Dec 11: Senior civil judge of Chitral Shoaib Khan stopped the district coordination officer the other day from constructing house near the local airport’s runway by vacating a stay order issued to him earlier this year.
DCO Rehmatullah Wazir had moved the court for staying the action on a show cause notice issued to him by Civil Aviation Authority (CAA) after he began building a house near the runway in a danger zone of the airport.
Initially, he was granted interim relief by the court and allowed to continue with the construction.
However, the court rejected his petition on Monday after lawyers of the two sides completed arguments.
The petitioner was told to contact CAA for getting a no objection certificate for the building of his house.
The court also asked CAA to do a technical inspection of the airport’s danger zone before declaring the areas, where houses and other structures could be built.
CAA was also told to make a proper policy on the issue within six months.
CAA had served the show cause notice on the DCO in June this year, saying his house was being built only 200 feet from the centreline of the runway though under the law, around 750 feet on either side of the runway should always remain clear.
CAA also said a pilot had filed a complaint against the said construction.
The lawyer for the DCO said his client owned a piece of land near the airport and therefore, he didn’t require CAA NOC for building a house on it.
