Petition against Musharraf, 12 SC judges filed
KARACHI: A petition was filed on Tuesday against former president retired Gen Pervez Musharraf and 12 former judges of the Supreme Court, including former chief justices Irshad Hasan Khan and Iftikhar Muhammed Chaudhry, seeking their trial under Article 6 of the constitution for abrogating the constitution.
The petition was filed in the Supreme Court Karachi Registry.
Petitioner Munir Ahmed filed the petition through his counsel Advocate Shafqat Ali Shah Masoomi, who sought trial of former judges for granting permission to former military ruler to make amendments to the constitution on May 12, 2000.
The petitioner said that the former CJP Irshad Hasan Khan, former judges Iftikhar Muhammed Chaudhry, Muhammed Bashir Jahangiri, Justice Shaikh Riaz Ahmed, Justice Nazim Hussain Siddiqui, Shaikh Ijaz Nisar, Abdur Rahman Khan, Chaudhry Muhammed Arif, Munir A. Shaikh, Rashid Aziz Khan, Qazi Muhammed Farooq, Rana Bhagwandas and others took oath unconstitutionally under the Provisional Constitutional Order (PCO) in 1999 and 2000 and assented the former military ruler’s decision of imposing emergency in the country.
He prayed to the court to immediately order the director general of the Federal Investigation Agency to form a special team of senior officer to investigate the matter so that action against the former president and former judges could be initiated under Article 6 of the constitution.
