Ouster of Swabi tehsil nazim, his deputy stayed

SWABI: The Peshawar High Court on Thursday issued a stay order on the appeal of Swabi tehsil nazim and naib nazim, who were ousted through a no-confidence motion.

PHC directed the officials concerned to stop work on the motion.

Tehsil nazim Wahid Shah and niab nazim Gohar Khan were ousted through a no-confidence motion on September 6 when Jamaat-i-Islami members revolted against them in the tehsil council. The JI leaders were supported by Pakistan Tehreek-i-Insaf and other parties to throw out the nazim and naib nazim.

However, Mr Wahid and Mr Gohar declared that the entire process was illegal and they would file a write petition in PHC.

Advocate Mohammad Ishfaq along with Advocate Mohammad Sajeed Afridi and Advocate Elahi Khan represented the ousted naib nazim in the court. He said that the bench comprising Justice Roohul Amin Khan Chamkani and Justice Younas Thaheem stayed the case. Next hearing in the case would be held on September 28.

Mr Khan said that the entire process of the no-confidence was not according to rules and regulations. The naib nazim was not allowed to preside over the proceeding and the session was presided over a rival member.

“There were various other illegal issues we raised in the petition. The same would be proved during the hearing,” he added.

Meanwhile, senior lawyer Mohammad Rashid has been made district chairman of Public Safety Commission and Mohammad Irshad would be his deputy, according to sources.

Mr Rashid belongs to Awami National Party. He is also former president of Swabi Bar Association.
