Court admits Haripur nazim’s plea against ouster for hearing
HARIPUR: The Abbottabad Circuit Bench of Peshawar High Court has accepted for regular hearing a writ petition of district nazim, Haripur, Adil Islam against his removal and served notices on the parties concerned, said counsel for the petitioner Junaid advocate here on Friday.
Adil Islam was removed through a vote of no-confidence by 56 members of 68-member house on January 14 on the charges of corruption, mismanagement and violation of party policy. However, he denied the charges and termed it political vendetta against him and his family and rejected the proceedings of no-confidence as against the rules of business of district council.
Mr Islam contended that he was kept in the dark about the no-trust move and if it was successful the naib nazim would have also been automatically removed from the office, but it did not happen in the present case.
Seeks entire record of no-trust proceedings
The petitioner prayed for declaring the no-trust proceedings against him as null and void.
The single bench of Justice Lal Jan Khatak while giving interim relief to the petitioner accepted his petition for hearing and served notices on district election commissioner and secretary and convener of the district council for producing the entire record of no-trust proceedings before the court.
The new date, however, was yet to be fixed, according to the petitioner’s counsel.
Meanwhile, the provincial election commission has through a letter written to district election commissioner about the de-notification of Adil Islam as district nazim pointed out that the documents sent to it carried deficiencies so the proceedings would take place once these deficiencies were removed.
The letter says that the documents sent to the provincial office were neither original nor attested by the secretary district council. The provincial election commissioner asked for sending original documents with the notice, if any, served and duly received by district nazim Adil Islam, informing him about the no-confidence motion and the charges levelled against him.
Meanwhile, PTI’s member district council from Darwesh union council, Raja Nasir Kiyani, has taken oath as officiating district nazim.
The house met with convener Agha Shabbir in the chair where he announced the name of Mr Kiyani as the officiating district nazim which was approved by 44 members of the house by show of hands. Later, the convener administered him the oath as officiating nazim.
