IHC bench questions ATC judge’s conduct

ISLAMABAD: A bench of the Islamabad High Court (IHC) on Wednesday expressed dissatisfaction with an Anti-Terrorism Court (ATC) Judge Abual Hasnat Mohammad Zulqarnain, questioning his impartiality and conduct, particularly in politically sensitive cases.

During a hearing, the IHC division bench comprising Justice Miangul Hasan Aurangzeb and Justice Arbab Mohammad Tahir, scrutinised Judge Zulqarnain’s actions in recent high-profile cases, including the controversial cipher trial.

Justice Aurangzeb, visibly perturbed, remarked that Zulqarnain was allegedly prioritising political agendas over judicial duties. “This man is kept here to carry out political activities,” Justice Aurangzeb stated, adding that the judge’s actions have led to ‘unprecedented injustices’. The court highlighted a letter previously sent to the Member Inspection Team, recommending Judge Zulqarnain’s transfer.

The court was hearing a petition related to the remand of PTI leader Azam Khan Swati.

The court was apprised about the procedural lapses in granting physical remand of Swati.

The IHC bench also questioned whether any cameras were installed in Judge Zulqarnain’s courtroom, suggesting the need for greater transparency.

Justice Aurangzeb urged the Additional Attorney General to address the issue with the Law Ministry, noting that ongoing ministry support for Zulqarnain only reinforces concerns over his actions.

The court has adjourned the hearing until Thursday.
