HYDERABAD: Case against doctor sent back to police
HYDERABAD, July 25: The Sindh High Court Hyderabad Circuit Bench on Wednesday ordered registration of an FIR against four doctors, including two assistant professors of the Liaquat University of Medical and Health Sciences (LUMH), provided cognisable offence is made out in the statement of applicant who claimed that his sister died due to their negligence, on June 12.
Mr Justice Rehmat Hussain Jaffery passed the order on a criminal miscellaneous application filed by Noor Mohammad Hingoro, a resident of Barchani Sharif village, Tando Mohammad Khan.
The court told the SHO Jamshoro Police Station that applicant would file an oral or written statement before him and his FIR should be registered if a cognisable offence was made out. It said the matter was required to be sent to police for further proceedings in accordance with law.
The applicant got his sister Maloka (35) admitted for the treatment of tumour on May 25 to the Liaquat University Hospital Jamshoro Branch. On June 1, Dr Abdul Razaq Sheikh, Chairman Department of Surgery LUMH, ordered to operate her but after eight days of surgery, the wound developed some complication and Dr Abdul Ghafoor Dalwani, without giving her anaesthesia washed the wound with forcep and fingers. As a result, he said, her conditioned worsened and doctors shifted her to the Civil Hospital on June 11 where on duty doctors and nurses didn't give any attention to the patient. He said his sister breathed her last on June 12.
He said his sister’s death was due to negligence and not natural. He held Dr Abdul Razaq Sheikh, Dr Abdul Ghafoor Dalwani, Dr Sikandar and Dr Naureen, who was later identified as Dr Ambreen Munir responsible. He prayed the court to order registration of an FIR against these doctors. He said doctors also misbehaved with patients and their attendants.
Prof Abdul Raza Shaikh in his comments said that the woman was operated after consent was taken on June 1. She was provisionally diagnosed as ileocaecal tuberculosis, he added. He said that the mass was stuck with the blood vessels and was mobilised with difficulty while a portion of mass was left behind to save blood vessels. He said the post-operative course was not smooth and on June 7, she developed fever and abdominal pain.
He said Dr Abdul Ghafoor opened two stitches on June 8, as an ultrasound showed moderate amount of fluid collection. He said she was shifted to the LUH Hyderabad on June 11 and was operated upon the same day by Dr Ghafoor Dalwani and she expired on June 12, while allegations levelled in application were baseless and false.
He further said that the patient was managed by him and Dr Ambreen Munir, Dr.Abdul Ghafoor and Sikandar properly and professionally.
He said he held inquiry and found no misbehaviour by the nursing staff.
