High Court seeks complainant in kite deaths case

LAHORE, Jan 21: The Lahore High Court on Monday sought “a complainant” to order registration of an FIR in the wake of the death of two boys because of kite flying.

The court put off the hearing till next week when the petitioner-lawyer, MD Tahir, declined to become the complainant for the registration of the FIR. “I am a petitioner and I can’t be the complainant,” the lawyer replied to the court query.

The petitioner seeks registration of criminal cases against police for the deaths of two children. “The police officials who failed in implementing the ban on kite-flying are responsible for the deaths,” the petitioner states.

The judge allowed the petitioner time for one week and directed him to appear before the court on next hearing with the information as to who would be the complainant in the case.

MD Tahir had filed two civil miscellaneous applications before the Lahore High Court for action against the responsible policemen in the wake of deaths in kite-flying activities. He said a child in Kamoke had died last week due to kit-flying. Another child from Hanjray Kalan village died on Oct 14, 2007, when a poisonous chemical-coated kite string slit his throat over Pattoki bridge, he said.

The petitioner states after the ‘illegal removal’ of Pakistan Chief Justice Iftikhar Mohammad Chaudhry, the kite-flying was going on unchecked. He said the CJP, after taking suo motu notice against the kite flying, had ensured the ban on the sport.

He said although law against kite flying was enacted but the law enforcing agencies could not implement it.
