JHANG, July 16: The Jhang district and sessions judge has ordered registration of a murder case against the SHO of Qadirpur police station, four constables and two other people.

The judge announced the order on Thursday on a writ petition filed by Bakhan Bibi, the mother of deceased Qaisar Baloch, who sought registration of a murder case against the SHO and his accomplices.

The petitioner submitted that SHO Talat Mahmood Hundal, his bodyguards, constables Ejaz and Asghar, and Elite Force constables Rana Babar and Ghulam Abbas, had killed her son Qaisar and grandson Asmatullah in a staged encounter on June 26.

She submitted that her son and grandson were killed in cold blood after being nabbed by the SHO and his accomplices over an enmity between the SHO and her son. She claimed that the SHO had been posted in the Qadirpur police station for the last one and a half years and was fond of raising cattle.

For this purpose, he had set up a cattle shed adjacent to his official quarters on the premises of police station. She contended that Qaisar's cousin, Nawaz Khan, had three very fine buffaloes which the SHO wanted to get free of cost.

On the refusal of Nawaz, the SHO turned against him and implicated him in a false case. He arrested Nawaz and took the buffaloes in his custody as case property. Qaisar pursued the case and the Jhang civil judge quashed the FIR and ordered that the buffaloes should be returned to Nawaz.

The SHO did not return the buffaloes despite the court orders. Qaisar had a quarrel with the SHO when he did not return the animals and he became the enemy of Qaisar. He ordered Taj Khan and Riaz Khan, who are said to be police touts and hardened criminals, to kill Qaisar.

They attacked him on January 5 and seriously injured him. A case was registered against the assailants but they were never arrested. Instead, the SHO registered a number of false cases against Qaisar and declared him a proclaimed offender.

The petitioner contended that on June 26, Qaisar along with his nephew Asmatullah and a relative Ejaz was going to Mandi Shah Jewna by a motorcycle. When they reached near Bhir in Daoka Balochan village, they were intercepted by the policemen led by the SHO.

They were in plain clothes. They caught the three and started beating them. After giving them a sound thrashing, the SHO asked them to run away. As they ran to save their lives, SHO Talat fired a shot which hit Qaisar in the back and he fell on the ground.

Asmatullah and Ejaz ran in different directions and the SHO ordered the four constables to shoot them. Three bullets hit Asmatullah in the back, neck and buttocks, while Ejaz managed to escape.

She claimed that a large number of people saw the whole episode and begged the SHO to spare their lives. She said she and her other relatives appeared before the Jhang DPO who ordered recording of their version in the previously registered FIR of encounter.

Aggrieved by the DPO's attitude, the petitioner moved the court of district and sessions judge who observed that mere recording of cross version was not sufficient relief to the petitioner and a separate FIR should be lodged against the SHO and the six people nominated by the petitioner.
