HYDERABAD: Warrant issued to SITE secretary
HYDERABAD, April 20: The Sindh High Court, Hyderabad circuit bench, here on Wednesday, issued a non-bailable warrant against and show- cause notice to the secretary of the Sindh Industrial Trading Estate, Karachi, for failing to appear in the court in a case relating to forced retirement of an electrician posted in the SITE, Kotri.
The court said that the a non-bailable warrant would be served to the SITE secretary, Nawaz Ali Jagirani, through the Hyderabad DPO and the Karachi capital city police officer for April 27, and the secretary would be required to explain why contempt proceedings should not be initiated against him.
Electrician Siraj Ali Shah had filed a constitutional petition before the court, saying that despite satisfactory performance over two decades, he was served with a charge-sheet, which was replied to in a plausible manner.
However, he added, the respondent without considering his reply awarded him with forced retirement, which he termed illegal.
He said that the Sindh Services Tribunal allowed his appeal and directed the respondent to hold fresh inquiry within 60 days. However, the inquiry was not concluded within the stipulated period, entitling him for benefits of the intervening period. He said that he was not found guilty in the inquiry report.
The petitioner’s lawyer, Fasahat Hussain Rizvi, contended that since the judgment of the tribunal was not contended before the Supreme Court, it attained finality and entitled his client to the benefits of the intervening period.
