GUJRAT: Police quash FIRs unilaterally: Plea for change of investigation

GUJRAT, Nov 1: Lalamusa police on Monday quashed two FIRs because the accused and complainant had applied for change of investigation in a Kharian court due to alleged partiality by the investigator.

Lalamusa police had registered a case under sections 440, 379, 427, 148 and 149 against Amjad Hussain of Dhama and four accused on the complaint of Anwar on Oct 2. Accused Amjad later moved the court of judge Muqarab Khan pleading that the police had implicated him and other family members in a fake case allegedly after taking bribe from the complainant. The investigator in the case is ASI Niaz Mekan.

The second FIR was lodged under sections 452, 337H2, 148 and 149 against six accused on the complaint of Saifullah on Oct 3 while investigator in the case is again ASI Niaz Mekan.

Saifullah later applied for change of investigation in the court of Muqarab Khan alleging that the investigator had sided with the accused and forced him for a patch-up.

The judge had directed the police to appear before court on Nov 4 with relevant records of the two FIRs.

At this, the investigator with the connivance of SHO Muhammad Anwar had quashed both the FIRs for the reasons best known to them. The investigator wrote in the case file of both cases that during secret and open investigation, it was found that both the incidents had not happened.

Meanwhile, legal experts said that no investigator could conduct further investigation in any case should the accused or the complainant applied for change of investigation.

SHOT DEAD: A man was shot dead by three dacoits during a dacoity bid in Sarai Alamgir on Sunday night.

Armed bandits entered the house of Muhammad Din, held up the inmates and started scooping cash and jewellery. The intruders shot dead Shahid for holding them out and escaped.

Meanwhile, thieves took away ghee worth Rs0.7 million from the godowns of Mushtaq in Jalalpur Jattan on Sunday night.
