PHC admits Nazim’s petition for hearing

SWABI, Nov 10: A division bench of the Peshawar High Court has declared that the single bench of the election tribunal cannot give its verdict on the writ petition filed by a defeated candidate for district Nazim slot till a decision of the high court is announced.

The divisional bench declared this after it had admitted for regular hearing the petition filed by the Nazim, Sher Zaman Sher, in connection with the submission of a fake certificate with nomination papers.

The bench comprising Justice Nasirul Mulk and Justice Shah Jehan had issued notice to the defeated candidate and directed the election tribunal to continue the trial against the Nazim but prevented it to give its final verdict before the high court verdict came on the petition.

The defeated candidate, Jehan Zeb Khan, had filed a writ petition in the election tribunal, claiming that since the elected district Nazim had submitted a “fake matriculation certificate” with his nomination papers, he should be disqualified.

But, Sher Zaman had disowned the certificate and said he had passed the SSC examination from Khushal College in Afghanistan.
