BHC CJ`s appointment challenged in apex court

QUETTA, Sept 9 Advocate Sajid Tareen, vice-president of the Balochistan National Party-Mengal, has filed a constitutional petition in the Supreme Court (Registry), Quetta, challenging the appointment of Justice Faez Isa Qazi as chief justice of the Balochistan High Court.

The petition states that the appointment is in conflict with the Article 193 of the Constitution which states that a lawyer with 10 years' experience may be appointed as an additional judge of the high court for one year on an ad-hoc basis.

The petitioner said that Justice Faez Isa was appointed directly as chief justice of the high court and on a permanent basis and not on an ad-hoc basis as envisaged in Article 193.

The second point raised by the petitioner concerns enrolment of Justice Faez Isa as a lawyer by the Sindh Bar Council, and not by the Balochistan Bar Council.

The petitioner said the appointment was also not in conformity with principles laid down in the Al-Jihad case.
